SC nullifies IHC stay order in multibillion corruption case against Tauqir Sadiq

ISLAMABAD, Mar 18 (Online): Supreme Court (SC) has declared Islamabad High Court (IHC) order staying the investigation into mega corruption case against Tauqir Sadiq null and void.

SC has maintained that IHC has stayed investigation into corruption of billion of rupees without issuing notice to NAB and hearing it, therefore, this decision does not meet all the legal requirements.

The SC has directed IHC to hear the petition of Deewan Petroleum without being influenced by the court’s verdict and decide it as soon as possible. IHC should give decision after hearing NAB.

A 3-member bench of SC led by Justice Jawwad S Khawaja gave this decision Tuesday.

Justice Jawwad S Khawaja remarked “ it is must to hear the arguments of all the parties concerned to meet the legal formalities while it has not been done so in the said case.

At the inception of hearing of the case KK Agha said only one matter was to be brought to fore in Ogra Corruption case. Tauqir Sadiq has stayed outside the country for two years. We can not arrest him as he has been granted bail.

Justice Jawwad remarked “ some things have to be done by Accountability Court Give application there. You have come against February, 25, 2014 order. We are going to grant permission for hearing your petition. How can the investigation be stalled without notice. We will declare this order void. We have our reservations if orders like this have been issued.

Ali Zafar said interim order was given and now 4 to 5 days have been elapsed.

Justice Jawwad remarked “ one month has been elapsed and not four or five days. Justice can be administered by fulfilling the rules and regulations. We have not nullified the high court order so far. Had high court done so that it should have issued one day notice to NAB then what would have happened. NAB headquarters is not far off. Court could have decided the matter by summoning the prosecutor general NAB the same day.
